Article 1 (Introduction)

These Terms of Service (hereinafter referred to as "Terms") set forth the conditions for using OTORATE (hereinafter referred to as "Service"). By using the Service, you are deemed to have agreed to these Terms.

Article 2 (Definitions)

The definitions of terms used in these Terms are as follows:

"User" refers to all persons who use the Service.
"Registered User" refers to a User who has completed account registration.
"Posted Content" refers to reviews, ratings, comments, and other information posted by Users on the Service.
"Administrator" refers to the person who operates and manages the Service.

Article 3 (Accounts)

Users may need to register an account to use certain features of the Service.
Users are responsible for maintaining accurate and up-to-date registration information.
Users shall not transfer, lend, or share their account information with third parties.
Account management is the User's responsibility, and the Service assumes no liability for unauthorized use by third parties.

Article 4 (Prohibited Activities)

Users shall not engage in the following activities when using the Service:

1. Prohibited Posting Activities

Defaming or slandering other Users, artists, or third parties
Posts containing discriminatory, insulting, or threatening expressions
Posting false information
Posts containing obscene or violent expressions
Posts infringing on copyrights, trademarks, or other intellectual property rights of others
Posts violating personal information or privacy
Spam activities or promotional posts
Repeatedly posting identical or similar content

2. Prohibited Service Usage Activities

Interfering with the operation of the Service
Unauthorized access or attacks on the system
Improper use of multiple accounts
Improper operations using automated tools
Activities violating laws or public order and morals
Other activities deemed inappropriate by the Administrator

Article 5 (Posted Content)

Users bear full responsibility for the content they post.
Copyright of Posted Content belongs to the User, but Users grant permission for display on the Service, sharing with other Users, and use for Service improvement.
The Service makes no guarantees regarding the accuracy, completeness, or usefulness of Posted Content.

Article 6 (Content Deletion and Account Suspension)

1. The Administrator may delete or hide Posted Content without prior notice in the following cases:

Posts violating these Terms
When a third party reports rights infringement
When violating or potentially violating laws
Other cases deemed inappropriate by the Administrator

2. The Administrator may temporarily or permanently suspend (ban) a User's account in the following cases:

Repeated violations of these Terms
Serious violations of these Terms
Actions causing significant inconvenience to other Users
Confirmed fraudulent activities
Other cases where the Administrator deems account suspension necessary

3. The Administrator is not obligated to disclose reasons for content deletion or account suspension.

4. The Service assumes no liability for damages arising from account suspension.

Article 7 (Disclaimer)

The Service may interrupt, suspend, change, or terminate the Service without prior notice to Users.
The Service assumes no liability for disputes between Users.
The Service assumes no liability for damages caused by Posted Content.
The Service does not guarantee the accuracy of information obtained from external services (MusicBrainz, Spotify, etc.).
The Service assumes no liability for damages arising from use of the Service, except in cases of intentional misconduct or gross negligence.

Article 8 (Service Changes and Termination)

The Service may change the content of the Service without prior notice to Users.
The Service may terminate the Service with prior notice to Users.
The Service assumes no liability for damages to Users resulting from changes or termination of the Service.

Article 9 (Intellectual Property Rights)

Copyrights, trademarks, and other intellectual property rights related to the Service belong to the Service or legitimate rights holders.
Users shall not reproduce, reprint, modify, or distribute the Service's content beyond the scope of private use.

Article 10 (Handling of Personal Information)

User personal information is handled in accordance with our separately established Privacy Policy.

Article 11 (Changes to Terms)

The Service may change these Terms as necessary.
Revised Terms shall become effective upon posting on the Service.
Using the Service after Terms revision shall be deemed consent to the revised Terms.

Article 12 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with Japanese law.
The Tokyo District Court shall have exclusive jurisdiction of first instance over disputes related to the Service.
